Upsi Terms of Use

Version 1, 16 October 2026. These terms apply to the Upsi app for macOS and to its website.

To be completed before publication: Emil Danilesco, natural person, Anenii Noi, Republic of Moldova (full address on request, by e-mail), [email protected]. This document must be reviewed by a lawyer from the Republic of Moldova before launch.

1. Who we are and what Upsi is

Upsi is a Mac app that watches over your own computer: it takes a photo with the camera when someone wakes the locked screen, enters a wrong password or logs in to the system, can take screenshots after a login, sends this information to your own Telegram chat and, if you turn on the "Shoulder Watch" feature, alerts you when a person behind you is looking at the screen. The app is provided by Emil Danilesco, natural person ("we", "us").

2. The basic rule: only on your own Mac

Upsi is installed and used only on a Mac that you own or are entitled to administer, in order to protect that Mac and the data on it. It is forbidden to:

  • install Upsi on another person's computer without their knowledge and explicit consent;
  • use Upsi to monitor a partner, a family member, an employee or any other person;
  • use the photos, screenshots or location obtained through Upsi to harass, blackmail, humiliate or publicly expose a person;
  • use Upsi in a way that breaks the law of the place where you are, including laws on recording people, data protection and employment.

You are responsible for how you use the app and for the content you obtain with it. When you first start the app, you confirm that you have read and will follow this rule.

3. How your data works

Upsi works on your Mac. Photos and screenshots are saved in the folder you choose and, if you have turned this on, they go straight from your Mac to your own Telegram bot, through Telegram's servers. We do not see or keep your photos. The details are in the Privacy Policy, which is part of these terms.

4. Trial period, price, subscription

  • The first 30 days after installation are free, with all features.
  • After that, Upsi costs 1 euro per year, for one Mac, with automatic yearly renewal. The final price shown at checkout includes the taxes that apply in your country.
  • Payment is made through Lemon Squeezy, which sells on our behalf, issues the invoice and the licence key, and handles taxes, refunds and cancellations. You can cancel the renewal at any time from the confirmation e-mail or from your Lemon Squeezy account; the app keeps working until the end of the paid period.
  • If you are a consumer in the European Union, you have the right to withdraw within 14 days of purchase, without giving a reason. Refund requests are sent to [email protected] or through Lemon Squeezy.
  • When the paid or trial period ends, Upsi stops taking photos and watching, but does not delete anything: your settings and the photos already taken stay on your Mac.
  • A licence key is for a single Mac; you can move it to another Mac by removing it from the first one, in the app.

5. What Upsi can and cannot do

Upsi depends on your Mac's camera, operating system and internet connection. We do not guarantee that every event will be photographed or that every message will arrive: a covered camera, a Mac that is switched off, no internet connection or a change in macOS can prevent this. Upsi cannot see the login screen after a restart and cannot stop someone from getting in; it documents what happened. It is not a substitute for a good password, for disk encryption or for insurance of your belongings.

6. Liability

The app is provided "as is". To the extent permitted by law, we are not liable for indirect losses (data, income, stolen belongings) resulting from using or not using the app, and our total liability to you is limited to the amount you paid in the last 12 months. Nothing in these terms limits the rights that the law gives you as a consumer and that cannot be limited.

7. Licence and ownership

We grant you a personal, non-exclusive, non-transferable licence to use Upsi in accordance with these terms. The Upsi name, the logo and the app belong to us. You may not sell, rent or redistribute the app or the licence keys.

8. Suspension of access

We may deactivate a licence key if it is used in breach of section 2 or obtained by fraud (for example, a disputed payment). In that case the amount paid is not refunded, unless the law requires otherwise.

9. Changes

We may change these terms; the new version is published on the website with its date. If a change is to your disadvantage, we will notify you in the app at least 14 days in advance.

10. Governing law and contact

These terms are governed by the law of the Republic of Moldova. If you are a consumer in another country, you remain protected by the mandatory rules of your country. Questions and complaints: [email protected]. We reply within 5 working days at most.

11. Provisions by country and region

Upsi is sold worldwide through Lemon Squeezy. The rules below are in addition to the terms above; where a local law gives you more rights, that law applies.

Republic of Moldova. The contract is concluded with Emil Danilesco, natural person. Law no. 105/2003 on consumer protection and the Civil Code apply. Complaints are sent to [email protected]; we reply within 5 working days. You may also contact the Agency for Consumer Protection and Market Surveillance.

European Union and European Economic Area.

  • Legal guarantee of conformity for digital content, minimum 2 years (Directive 2019/770/EU): if the app does not do what we promise, you are entitled to a remedy, a price reduction or termination of the contract.
  • The price shown at checkout includes your country's VAT; Lemon Squeezy collects it and pays it as a registered seller.
  • The yearly subscription renews automatically; you receive an e-mail before renewal and can cancel at any time, with one click, from that e-mail or from your Lemon Squeezy account.
  • European online dispute resolution platform: ec.europa.eu/consumers/odr. We are not obliged to, and do not, take part in alternative dispute resolution procedures, but we reply to every complaint.

United Kingdom. 14-day right to cancel (Consumer Contracts Regulations 2013) and the guarantee of conformity for digital content (Consumer Rights Act 2015). The price includes UK VAT, collected by Lemon Squeezy.

United States. Automatic renewal is clearly described at purchase, you accept it explicitly, you receive a reminder e-mail before each yearly renewal, and you can cancel online, as easily as you bought (including under the automatic renewal laws of California, New York and other states). Sales taxes, where they apply, are calculated and collected by Lemon Squeezy. The app is provided "as is", without implied warranties of merchantability or fitness for a particular purpose, to the extent permitted by the law of your state; some states do not allow this limitation, in which case it does not apply to you.

Canada. Provincial consumer protection laws apply (for example the Loi sur la protection du consommateur in Québec, with the right to cancel distance contracts). GST/HST/QST taxes are collected by Lemon Squeezy.

Switzerland, Norway, other countries. The mandatory rights of your country apply; the price includes local taxes collected by Lemon Squeezy where it is registered.

Countries where purchase is not possible. Lemon Squeezy does not process payments from countries under international sanctions or where it does not operate (among others Russia, Belarus, Iran, North Korea, Syria, Cuba, the occupied regions of Ukraine). There, Upsi can only be used during the trial period or with a key received from us. The exact list is the one published by Lemon Squeezy at the time of payment.

12. Local laws on recording people

Laws on photographing, filming and monitoring people differ from country to country and are your responsibility as a user. A few guidelines, which are not legal advice:

  • At home, on your own computer, documenting whoever tampers with your Mac is generally permitted everywhere.
  • At work, in many countries (EU, United Kingdom, Moldova) employees must be informed of any monitoring; if you install Upsi on a work Mac, follow your employer's policy and employment law.
  • In public places ("Shoulder Watch" feature), keep the app's defaults: no saving and no sending of frames that show other people.
  • It is forbidden to install Upsi on another person's computer without their consent; in many countries this is a criminal offence (unauthorised access, covert surveillance).
